“LARK ON PREMISE: CHANCE TO WIN A TRIP TO LARK DISTILLERY IN TASMANIA FOR 2 PEOPLE” PROMOTION

TERMS AND CONDITIONS

  1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. The Promoter is Spirits Platform Pty Ltd (ABN 44 604 520 783) of Level 2, 40 Lord Street, Botany, NSW 2019 (“Promoter”).
  3. Entry is only open to on-premise venues operating in Australia (excluding NT) invited by the Promoter to participate in the promotion (each an “Eligible Venue”).
  4. Eligible Venues must be within the Promoter’s trading terms throughout the Promotional Period and must not have overdue monies owing as at the 30/06/2026 in order to be eligible to claim any prize.
  5. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st
  6. Entries into the promotion open on 01/04/2026 and close at 11:59pm AEST on 30/06/2026 (“Promotional Period”).
  7. To be eligible to enter, Eligible Venues must complete the entry criteria in either the Silver tier or Bronze tier (as listed below) during the Promotional Period:

Silver Requirements

  • An authorised representative on behalf of the Eligible Venue must visit https://www.winwithspirits.com.au/LARK-Distillery-On-Premise-Trade-Comp/ and register their Eligible Venue for participation in the promotion, by completing the online entry form;
  • Purchase a minimum of one (1) bottle each of 151 Lark Fire Trail and No. 183 Devil’s Storm (i.e. minimum two (2) bottles) from Spirits Platform via the standard ordering processes;
  • Range 151 Lark Fire Trail and No. 183 Devil’s Storm in the Eligible Venue; and
  • Include a menu feature for 151 Lark Fire Trail and No. 183 Devil’s Storm on the Eligible Venue’s menu for the duration of the Promotional Period, or from the date the Eligible Venue receives its stock (whichever is later), until the end of the Promotional Period and upload an image of the menu feature for No. 151 Lark Fire Trail and No. 183 Devil’s Storm in the online entry form.

Eligible Venues that complete the above Silver Requirements will be awarded three (3) entries into the draw.

Bronze Requirements

  • An authorised representative on behalf of the Eligible Venue must visit https://www.winwithspirits.com.au/LARK-Distillery-On-Premise-Trade-Comp/ and register their Eligible Venue for participation in the promotion, by completing the online entry form;
  • Purchase a minimum of one (1) bottle 151 Lark Fire Trail from Spirits Platform via the standard ordering processes;
  • Range 151 Lark Fire Trail in the Eligible Venue; and
  • Include a menu feature for 151 Lark Fire Trail on the Eligible Venue’s menu for the duration of the Promotional Period, or from the date the Eligible Venue receives its stock (whichever is later), until the end of the Promotional Period and upload an image of the menu feature for No. 151 Lark Fire Trail in the online entry form.

Eligible Venues that complete the above Bronze Requirements will be awarded one (1) entry into the draw.

  1. The Promoter, reserves the right, at any time, to verify the validity of Eligible Venues (including but not limited to their order history menu and back bar visibility) and reserves the right, in its sole discretion, to disqualify any venue who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  2. Incomplete, indecipherable or illegible entries will be deemed invalid.
  3. The draw will take place at Anisimoff Legal, Level 3, 162 Collins Street, Melbourne VIC 3000 at 11:00am AEST on 07/07/2026, in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible venue is drawn. The winning Eligible Venues will be notified in writing by email within seven days of the draw. The names and postcodes of winning Eligible Venues will be published online at https://www.winwithspirits.com.au/LARK-Distillery-On-Premise-Trade-Comp/ on 14/07/2026.
  4. The Promoter’s decision is final and no correspondence will be entered into.
  5. The first five (5) valid Eligible Venues drawn will each win a prize. Prizes will be awarded to the owner/manager of the Eligible Venue who may, in their absolute discretion, allocate the prize to any employee of that winning Eligible Venue aged 18 years or over (the “Prize Taker”). The owner/manager must notify the Promoter of that transfer (in writing) by 24/09/26 and must not issue the prize without the Promoter’s approval. Approval of the transfer is at the Promoter’s sole discretion.
  6. Only one (1) prize is permitted per Eligible Venue.
  7. Each prize is a trip for two (2) adults to the Lark distillery in Hobart, Tasmania valued at up to $5,500 depending on date and point of departure. Prize includes:
  • Two (2) x return economy airfares from Prize Takers nearest capital city to Hobart, Tasmania (only provided if the Prize Taker resides outside of Tasmania). If the Prize Taker is from Tasmania, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash;
  • Return airport to hotel transfers for two (2) adults;
  • Two (2) nights accommodation (in two (2) rooms) at Crowne Plaza Hobart including breakfast;
  • Lunch for two (2) valued at up to $70 on Day 1 and up to $80 on Day 2 and Dinner on Day 1 valued at up to $120, exact locations and menus to be determined by the Promoter in its absolute discretion;
  • A distillery tour for two (2) adults at Lark Distillery in Hobart including return hotel to distillery transfers; and
  • A half day activity for two (2) adults in Hobart to be determined by the Promoter in its absolute discretion. 

Spending money, additional meals, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 31/10/2026 and is subject to booking and flight availability. Prize cannot be taken during Australian school holidays, public holidays or other peak periods.

  1. Prize Taker and their companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Prize Taker may be required to present their credit card at time of accommodation check in.
  2. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster or unforeseeable event beyond the reasonable control of the Promoter, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
  3. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Entry and continued participation in this promotion is subject to the licensee’s liquor serving policy.
  4. The Lark Distillery tour and half day activity prize components are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or their companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
  5. Subject to the unclaimed prize draw clause, if for any reason a winning Eligible Venue or Prize Taker does not take / redeem a prize (or an element of a prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  6. Prize/s must be claimed by 07/08/2026 (for the original drawn winning Eligible Venues) and 10/09/2026 (for any prizes/Eligible Venues drawn in the unclaimed prize draw, if any).
  7. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  8. Total prize pool value is up to $27,500. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  9. A draw for any unclaimed prizes may take place on 10/08/2026 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winning Eligible Venues, if any, will be notified in writing by email within seven (7) days of the draw and the names and postcodes of any winning Eligible Venues will be published online at https://spiritsplatform.com.au/LARK-Distillery-On-Premise-Trade-Comp/ on 17/08/2026.
  10. Authorised representatives on behalf of Eligible Venues and Prize Takers consent to the Promoter using their name, likeness, image and/or voice in the event they are a winning Eligible Venue/Prize Taker (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  11. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any venue; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  12. Any cost associated with accessing the promotional website is the Eligible Venues responsibility and is dependent on the Internet service provider used.
  13. Liability for any tax (other than FBT) arising out of participation in this promotion (including acceptance of a prize) is the sole responsibility of the Eligible Venue and/or Prize Taker. Eligible Venues/Prize Takers should seek independent financial advice in this regard.
  14. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  15. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the distillery tour and/or half day activity is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winning Eligible Venue and/or Prize Taker; or (g) use of a prize.
  16. As a condition of accepting the prize, authorised representative on behalf of a winning Eligible Venue and Prize Taker (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  17. The Promoter collects personal information (“PI“) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://spiritsplatform.com.au/privacy-policy.In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Venue. The Privacy Policy also contains information about how authorised representatives on behalf of Eligible Venues may opt out, access, update or correct their PI, how authorised representatives on behalf of Eligible Venues may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
