PARTICIPATING VENUES TERMS AND CONDITIONS

1. Information on How to Enter and Prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. Entry is only open to residents of Australia aged 18 years or older. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies who are directly associated with the conduct of this competition, are ineligible to enter the competition. 3. “Participating Venues” means Independent Bottle Shops within Australia that display advertising material for this promotion. There will be a total of 60 Participating Venues for this promotion nationally. 4. The promotion will only be able to be conducted in Participating Venues during opening hours for a duration six (6) week period, and must be conducted and concluded between Sunday 1st July 2018 and Monday 31st December 2018 (“Promotion Period”). 5. How to enter: To be eligible to enter the Promotion, entrants must, during the Promotional Period: a) Purchase any Tia Maria 700ml bottle in a single transaction at a Participating Venue (“Qualifying Transaction”) and obtain an entry form. b) Submit a completed entry form into the entry box kept at the Participating Venue. In completing the entry form, entrants must include their full name, telephone number and a valid and current email address and their answer to the question “In 25 words or less, what is your twist on an Espresso Martini?” c) Retain the original receipt issued by a Participating Venue as evidence of purchase. 6. The Promoter reserves the right, at any time, to verify the validity of entries details (including a claimant’s identity, age and place of residence) and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions or tampers with entries. Errors and omissions may be accepted at the Promoter’s discretion. 7. Incomplete, indecipherable or illegible entries will be deemed invalid. 8. Multiple entries accepted however each entry must be based on a separate Eligible Purchase, must be submitted separately, have a different answer and must independently comply with these Conditions of Entry. 9. The Promotion is a game of skill. Entries from each of the Participating Venues will be judged by a representative of the Promoter and the winner shall be the one to have the most creative answer. The judging will take place within each Participating Venue at the date and time as stated on the POS Poster. Winners will be notified in writing via email within two business days of the winner being judged. All winners will have their details published on the www.spiritsplatform.com.au/tiamaria-winners within 10 business days. 10. The Promoter’s decision is final and no correspondence will be entered into. 11. The judging will take place from all entries received in a Participating Venue and the winner will win a Delonghi Dedica Pump Coffee Machine (colour metal) valued at $429rrp. 12. The total prize pool value for this promotion is $25,740 inclusive of GST. Prizes are the recommended retail value as provided by the supplier and are correct at the time of printing. Total number of prizes is 60 and the prize pool value for each state/territory is: NSW = 18, QLD = 16, VIC = 12, SA/NT = 7, WA = 7. 13. Prizes must be collected from the Participating Off-Premise Venue at which they were won. If for any reason a winner does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited. 14. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification. 15. Prizes are not transferable or exchangeable and cannot be taken as cash. 16. For any prize that remains unclaimed in any Participating Venues, a judging will take place at the same time and place as the original judging for that Participating Venue on Friday 5th April 2019. Winners in any unclaimed prize draws will be notified in writing by email within two business days of the judging and the names of any winners will be published on 15th April 2019 on the website www.spiritsplatform.com.au/tiamaria-winners. 17. Entrants grant the Promoter permission to communicate with them by email and/or SMS in order to provide details of the prize and/or instructions as to how the winner is to claim the prize and establish his/her entitlement to it. 18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 19. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by any winner or entrant; or (f) use of a prize. 20. The information Entrants provide to the Promoter or in respect of the Competition will be used by the Promoter for the purpose of conducting the Competition. 22. The Promoter may disclose any Entrants’ personal information to its contractors and agents to assist in conducting the Competition or communicating with Entrants. 23.
